Alleges Political Motivation and Mishandling of Evidence
Washington, D.C. - Hunter Biden filed a request to dismiss the federal gun case against him, asserting that it is politically motivated and that key evidence was mishandled. According to his defense attorney, the cocaine residue found on the pouch containing his gun was only discovered last year, long after charges were filed.
Mishandling of Evidence Raises Concerns
The defense argues that the pouch, originally found in a trash can, was never tested for fingerprints or to determine the duration of the cocaine residue's presence. This neglect, as defense attorney Abbe Lowell emphasized, is "clear evidence" of selective prosecution. The pouch had been in police evidence storage since 2018, and its testing last year was seen as an attempt to strengthen the case against Hunter Biden.
Political Pressure Influences Plea Deal
Prosecutors had initially considered a plea deal in the case. However, they allegedly succumbed to "political pressure" after the agreement faced opposition in court and garnered criticism from Republicans, including former President Donald Trump, who referred to it as a "sweetheart deal."
In response to these claims, prosecutors maintain that there is no political motivation behind the charges. They insist that the evidence against Hunter Biden is overwhelming and that politicians' opinions had no bearing on their decision to proceed with the case.
Hunter Biden's Defense
Hunter Biden has pleaded not guilty to allegations of lying about his drug use in October 2018 when purchasing a gun that he possessed for approximately 11 days. Although he admits struggling with a crack cocaine addiction during that period, his legal team contends that he did not violate any laws and suggests that a non-violent, first-time offender would not have faced charges under similar circumstances.
Trial Looms amidst Political Climate
The investigation, which spanned several years, appeared to be nearing resolution with a potential plea deal in the previous year. However, the agreement fell apart, and now Hunter Biden faces the possibility of a trial this year. These legal proceedings coincide with President Joe Biden's re-election campaign.
In addition to the federal gun case, Hunter Biden is also confronting tax charges in Los Angeles. The indictment in Delaware followed the breakdown of the plea deal after a judge raised significant questions during a hearing that was intended to approve it.
